General Terms and Conditions of Sale

ARTICLE 1. PURPOSE

These General Terms and Conditions of Sale (hereinafter referred to as "GTC") govern the contractual relationships for any physical book purchase between Éditions Taos and any individual or legal entity who places an order via this website (hereinafter referred to as the "client").
These GTC apply to one-time purchases of physical books on the www.editaos.com website (for deliveries to the countries listed in ARTICLE 8. DELIVERY) and cover all books published under the Éditions Taos brand.
These GTC will be the only terms applicable, even if otherwise stated in any other document.
Simply placing an order by clicking the "Confirm" button implies the client’s automatic, irrevocable, full, and unconditional acceptance of these General Terms and Conditions of Sale.
No specific terms may override these GTC unless formally accepted in writing by Éditions Taos.
Éditions Taos reserves the right to modify or amend these GTC at any time.
The GTC in effect at the time of the client’s order confirmation will apply.

ARTICLE 2. SERVICES OFFERED ON THE SITE

Éditions Taos offers the following services to users and clients on its website:

  • • Access to the Éditions Taos catalog
  • • Subscription to the newsletter
  • • The ability to purchase physical books directly on the website
  • • The ability to contact Éditions Taos for any inquiries via the "Contact Us" tab.

Regarding the listing of books, content, and services available on the site, these are determined solely by the editorial policy of Éditions Taos.

ARTICLE 3. AVAILABILITY

Éditions Taos makes its catalog of printed books available for sale while they are listed online, subject to availability and exceptions noted.
If a physical book ordered is unavailable:
If payment has already been made, you may choose one of the following options:

  • • Cancel the ordered product, with a refund of the product (excluding flat-rate delivery charges in the case of a partial order cancellation);
  • • Replace the unavailable product with another product of your choice that is identical in nature and value to the originally ordered product, meaning at the same price (if the replacement product has a different price, the order must be canceled and a new one placed);
  • • Confirm your order for the affected product, which includes accepting the extended delivery time (for available products with extended delivery times).

If payment has not yet been made, you may choose from the following options:

  • • Cancel the ordered product;
  • • Replace the unavailable product with another product of your choice that is identical in nature and value to the originally ordered product, meaning another title at the same price (if the replacement product has a different price, the order must be canceled and a new one placed);
  • • Confirm your order for the affected product, which includes accepting the extended delivery time (for available products with extended delivery times).

Your response must be sent by email to Éditions Taos:

  • • Within 7 days of the email sent by Éditions Taos notifying you of the extended delivery time.
  • • Or within 15 days of the email sent by Éditions Taos notifying you of the unavailability of the ordered product.

If no response is received within the given time frame:

  • • In the case of an extended delivery time, the product will be delivered within the new specified timeframe.
  • • In the case of permanent unavailability, and if payment has already been made, we will refund the amounts paid for the unavailable product(s) (excluding flat-rate delivery charges in the case of a partial order cancellation).

If a refund is due, it will be issued in the same way as the original payment (the credit card used for the purchase will be credited or a check made out to the client will be sent to the postal address used in the order). If the refund cannot be processed this way due to a reason beyond the control of Éditions Taos (e.g., invalid postal address or inactive credit card), Éditions Taos will contact the client.

ARTICLE 4. HOW TO PLACE AN ORDER ON THE SITE

Who can order?
Any individual aged 18 or older with the legal capacity to enter into a sales contract, or any legal entity.
Physical books must be delivered to an authorized country (see ARTICLE 8. DELIVERY).

How to place an order?
Click the "Add to Cart" button to select a book. The cart will open, and you can choose to complete your order or continue shopping. The cart can be closed with a single click and is always accessible via the "Cart" link at the top of the page.

1. Cart

The "Cart" screen summarizes the books you wish to purchase. You can modify your selection at any time before final confirmation: add or remove titles, or change the quantities ordered. Click "Checkout" to confirm your cart.

2. Address

The following information must be provided: Title, First Name, Last Name, Email, Country, Company/Organization Name (if applicable), Address, Postal Code, City. If necessary, you can enter a different billing address from the delivery address.
Fields marked with an asterisk are mandatory.
Once the information is filled in, the "Pay" button will take you to the Payment page.
Please note that you can always go back to the previous screen to modify your order.

3. Payment

3.1. A summary of your order with a payment obligation is displayed.
3.2. You must read these GTC and check the box "I accept and acknowledge having read the general terms and conditions of sale and use" to proceed.
3.3. Then, select your payment method by clicking "I will pay by check" or "I will pay by credit card" (*Order with purchase obligation).
3.4. The payment methods are outlined in ARTICLE 6. PAYMENT METHODS.

4. Order Summary

Once your order has been confirmed and paid, by any payment method, the "Order Summary" screen will appear.
After selecting the books, confirming your choice, accepting these GTC, and completing the payment, a confirmation email summarizing the transaction will be sent to you.

The confirmation email will include:

  • • The contact details of Éditions Taos
  • • The total transaction amount, including all taxes
  • • The transaction date
  • • A description of the selected books
  • • A link to these GTC that you accepted beforehand
  • • The withdrawal period available to you and how to exercise it, in the case of physical book purchases only

ARTICLE 5. PRICING

The prices of the books offered by Éditions Taos are quoted in Euros, including all taxes, excluding shipping fees, and are subject to change, for delivery within mainland France.
The prices include French VAT.
All orders, regardless of their origin, will be invoiced and payable in Euros.
Éditions Taos reserves the right to modify its prices at any time, but products will be invoiced based on the rates in effect at the time the order is placed, subject to availability.

ARTICLE 6. PAYMENT METHODS

6.1. For physical books:

You can pay for the selected physical books on our website:

  • • By immediate payment using a credit card
  • • By bank or postal check in Euros, drawn on a French bank only

6.2. Payment by check

If you choose to pay by check when purchasing physical books, a window summarizing your order will appear. Even though a confirmation email ("Order Receipt") will be sent, we recommend printing or saving the displayed summary.
You have 15 days to send your check payable to Éditions Taos. Please write the order number on the back of the check!
Note: Your order will only be processed after we receive your check, verify your order, and confirm its payment. The check will be cashed upon receipt. If you choose to pay by check, the delivery times will be extended. After the 15-day period, if we do not receive the corresponding check, Éditions Taos will automatically cancel your order.

6.3. Payment by credit card

Your order must be paid online in Euros using Visa, Eurocard, or Mastercard.
When choosing to pay by credit card, you will be redirected to a secure payment server that ensures the transaction’s security and discretion towards the merchant website. Therefore, none of your banking details will be stored on our site.
The transaction is secured through the SSL (Secure Socket Layers) system: all order-related data (name, address, card number, security code) are encrypted. The small padlock icon confirms that secure mode is activated.
However, by agreeing to pay online, you acknowledge the inherent risks of this procedure and waive any claims and/or actions of any kind against Éditions Taos in the event of interception and/or misuse of your banking details by a third party without your knowledge or consent.
Should you encounter any payment issues, please notify us by email at: taos@editaos.com. The data recorded by the payment system will serve as proof of all transactions completed with Éditions Taos, which you accept irrevocably and without reservation.
You will enter your card number, expiration date, and the security code from the back of your card, then validate the transaction. The payment server will request authorization to verify the validity of your card. The screen will then display whether the payment authorization was granted by the bank. Éditions Taos’ Customer Service will be notified of the validity of your payment and will confirm by email that your order has been received.

ARTICLE 7. PROCESSING ORDERS PLACED ON THE WEBSITE

Éditions Taos will systematically acknowledge receipt of your online order by sending you an email.
Our delivery times include the time needed to process your order and ship your package.

ARTICLE 8. DELIVERY

8.1. Delivery – physical book orders

Your order can be delivered within France. The books will be delivered to the shipping address you provided during the order process, which may differ from the billing address.

8.2. Delivery times and fees

The shipping times provided are average estimates and may vary depending on the destination. To ensure optimal service, we ask that you always provide an address where your order can be delivered during business hours. Once the products have been physically received by you or any third party designated by you (other than the carrier), you will bear the risks associated with the ordered books. In the event of damage, theft, or loss of the ordered books during shipment, you must notify the carrier upon delivery or send a registered letter with acknowledgment of receipt within 3 days.
Some books ordered may be out of stock or not yet published at the time of your order. Your invoice will inform you that these books will be sent as they become available.
If you do not wish to wait for these books, you may request to cancel the order by contacting our Customer Service.

ARTICLE 9. RIGHT OF WITHDRAWAL – WARRANTIES

9.1. Right of withdrawal

9.1.1. For physical books:

In accordance with Articles L.121-21 and following of the Consumer Code, you have a period of fourteen (14) days from the date of receipt of the ordered products, either by you or by a third party designated by you (other than the carrier), to exercise your right of withdrawal without having to provide any reasons or pay penalties, except for return shipping costs.

To exercise your right of withdrawal within the fourteen (14) day period, you must notify us of your decision to withdraw within this period, by submitting an unambiguous written declaration sent via your preferred method:

Note: Please remember that the products must be returned in good condition and in their original packaging if applicable.
At the same time, you must return the products subject to this withdrawal within the same period, following the procedure described in ARTICLE 9.2 RETURNS.

Return shipping costs are your responsibility, and we do not accept shipments with postage due or COD.

If your withdrawal is valid, we will refund all payments received from you for the relevant product(s), including delivery charges if the entire order is returned, except for any additional charges resulting from your choice of a delivery method other than the least expensive standard delivery offered by us. The refund will be processed without undue delay, and in any event, within fourteen (14) days from the date we are informed of your decision to withdraw. We may, however, delay the refund until we have received the product(s) or until you provide proof of return, whichever comes first.

We will process the refund using the same payment method you used for the order (either the credit card used for the purchase will be credited, or a check made out to the customer will be sent to the address provided in the order), unless we expressly agree to use a different method. In any case, the refund will not incur any fees for you.

9.2. Returns

Éditions Taos will, at your choice, either exchange or refund the product(s). The initial shipping and return costs will be refunded based on the standard rate (excluding any additional charges resulting from your choice of a more expensive delivery method than the standard option).

9.3. Legal guarantees

Non-conformity:
We commit to refunding or exchanging products that do not conform to the applicable legal provisions:

  • • The ordered product must be suitable for the usual use expected of a similar product, and if applicable, (i) match the description given by the seller and have the qualities presented to the buyer (excluding non-contractual images), (ii) have the qualities that a buyer can reasonably expect based on the public statements made by the seller, producer, or their representative, particularly in advertising or labeling.
  • • Alternatively, the ordered product must have the characteristics defined by mutual agreement between the parties or be suitable for any specific use sought by the buyer, brought to the seller’s attention, and accepted by the seller.

This conformity guarantee is valid for twenty-four (24) months from the date of delivery of the product.

Hidden defects: We commit to refunding or exchanging products that are apparently defective, damaged, or broken, in accordance with applicable legal provisions:

  • • A hidden defect is any concealed flaw that renders the ordered product unfit for its intended use, or so significantly reduces its usability that the buyer would not have purchased it or would have paid a lower price had they been aware of the defect.

This hidden defect warranty is valid for twenty-four (24) months from the discovery of the defect.

Enforcing the guarantees: In the case of non-conformity or hidden defects, please notify us within the required timeframe, providing detailed information, and send the product(s) to the address indicated in ARTICLE 9.2 RETURNS. Please make sure to include your full name, postal and email addresses, and customer ID (client number).

ARTICLE 10. ENTIRE AGREEMENT

These GTC represent the entire agreement between you and Éditions Taos regarding the subject matter outlined in ARTICLE 1.

Éditions Taos recommends that you retain a printed copy of these General Terms and Conditions of Sale, as well as any other documents sent by Éditions Taos in connection with your order.
